Can the world remove Maduro from power? Dean of Saban Law Faculty Warns that the Ministry of Internal Affairs may issue a warrant for the dictator’s arrest

Maria Karina Machado’s images this Thursday were touching. The Venezuelan leader spoke from the roof of a car and without a microphone to a crowd of excited compatriots who risked their lives and integrity to defend the dream of rebuilding the country they lost at the hands of a dictatorial and illegal regime. It should remind the world that now is not the time to leave them alone.

Although confidence in multilateral mechanisms, diplomacy and international law has been undermined, democracy may return to Venezuela. The fall of the regime will not be achieved by international pressure from countries that will ignore his government, or by a decision of an international court, by one or a thousand reports, by a military invasion by a foreign state or a private mercenary, or, unfortunately, because people take to the streets day after day. . The departure of the regime from power will be possible only with a combination of all these factors and consistency in its implementation.

Second, the report published by the IACHR revealed the Maduro regime’s practices of state terrorism, political persecution, repression, media harassment and arbitrary arrests following its electoral defeat in an undemocratic environment of executive co-optation. The work done by the Commission is very important, it will continue to remember that what is happening in Venezuela is a problem for the whole region and especially for Colombia.

Third, the Venezuela I case, which Argentina, Canada, Colombia, Chile, Paraguay and Peru submitted to the ICC in 2018, was joined by Uruguay at the end of 2024, and by Ecuador on January 9. The events of the last few days add to the long list of events that have been assessed as crimes against humanity. It is very likely that an arrest warrant will be issued this year for Nicolás Maduro, Diazdad Cabello, Tarek William Saab, Vladimir Padrin López, the heads of the National Guard, Sebin, or the Office of Counterintelligence. The key will be to identify elements to incriminate the middle managers who are believed to be most responsible, because this will accelerate the internal fragmentation of the Armed Forces, a bastion of dictatorship.

The expected decision of the Ministry of Foreign Affairs of Colombia not to recognize the results of the elections in Venezuela, that they recognized Maduro as the presumptive winner, albeit coolly because of the decision to accompany their ambassador to the inauguration, is another reassuring breath of air.

The world will not stop fighting for Venezuela. Finally, hope, as Emily Dickinson said, “is that feather that settles in the soul, and sings tunes without words, and never quite stops, and it sounds sweeter in the storm; and cruel must be the storm that can knock down the little bird that has given shelter to many.’
