The Social Court No. 1 of Cáceres declared the right of a woman to receive assistance for the care of a child affected by a serious illness with a psychomotor disability of 93%, which was denied by the Security Social joint officer.
The plaintiff, who worked as a nurse at the clinic, demanded from the company a reduction in working hours and then financial assistance for child care, which was rejected.
According to the note of the Superior Court of Extremadura (TSJEx), the verdict states that his minor son has cerebral palsy, with severe cognitive impairment and lack of language, and that he is on the list of serious diseases of the DR. 1148/2011.
For this reason, he points out, “if not the best social security criteria, this degree of serious dependence requires additional compared to usual care in long-term and daily care that goes beyond those already necessary for survival.”
The sentence is not final and can be appealed in the Public Chamber of the Superior Court of Extremadura.
